Attorney General Ken Cuccinelli offered the following response to Tuesday's visit by HHS Secretary Kathleen Sebelius:
"It's great to see Secretary Sebelius visiting Virginia today - I hope while she's here she can address some of the concerns that we Virginians have regarding the constitutionality of some of President Obama's key initiatives.
We would appreciate it if she could explain why, instead of focusing on what Americans cared about the most - jobs and the economy - President Obama and his team spent an entire year working to pass one of the most enormous and unpopular (and we believe unconstitutional!) pieces of legislation in American history.
Secretary Sebelius should also explain why they have put a cadre of unelected bureaucrats like her in charge of determining what is and what isn't sufficient health insurance for each and every American, taking that choice away from Virginians and their employers.
Nowhere in the Constitution is the Federal Government allowed the power to require Americans to buy health insurance simply as a condition of being alive, something I'm hopeful the U.S. Supreme Court will reaffirm in the not-too-distant future.
Time and again, the Obama administration has pushed aside constitutional and legal constraints to enact their economically destructive liberal policy agenda. That must come to an end in November.
Virginians deserve a President that will support, protect, and defend the Constitution. They deserve better than President Obama, Secretary Sebelius and their team and come November I'm confident we'll win Virginia for Governor Romney."
